When a person wrongfully obtains and uses another person’s information in a fraudulent way, typically for that person’s own economic gain, he has committed Identity Theft. A social security number, a bank account or credit card number, and a telephone calling card number are the most common types of information that are obtained and used by offenders of this crime.

Punishments and penalties for the crime of identity theft vary depending on whether the crime is prosecuted by the state or federal government or is charged as a misdemeanor or a felony.

For example, California Penal Code 530.5 is a felony charged against people who use the personal information of another person without the authorization of that person for any unlawful purpose. Identification fraud, credit card fraud, computer fraud, and mail fraud are common types of charges brought against an offender under 530.5.

Similarly, the federal “Identity Theft and Assumption Deterrence Act” prohibits unauthorized people from knowingly transferring or using the identification of another person with the intent to commit, or to aid or abet, any unlawful activity. This offense, as defined in 18 U.S.C. § 1028(a)(7) up to 15 years’ imprisonment, a fine, and criminal forfeiture of any personal property used or intended to be used to commit the offense.
