A Certificate of Rehabilitation is a court declaration announcing that a convicted offender is now rehabilitated.
Penal Code sections 4852.01 to 4852.21 governs certificates of rehabilitation. Generally, an individual may apply for a Certificate of Rehabilitation under these sections if that individual was convicted of a felony, served parole, and has not been incarcerated since release from parole.
An individual seeking to apply for a Certificate of Rehabilitation may file a petition with the Superior Court in the individual’s county of residence upon completion of rehabilitation. The period of rehabilitation is measured from the date of discharge from incarceration. If the Court finds that the individual has been rehabilitated, a Certificate of Rehabilitation is issued, enabling the individual to apply for a pardon thereafter. Although a Certification of Rehabilitation is necessary in order to apply for a pardon, it does not guarantee one.
